Which trademark class does an app fall under?
Class 9 covers downloadable software, which is where nearly every mobile app sits. If your app is a hosted service with a mobile front end, Class 42 (software as a service) usually applies as well. Games often add Class 41, fintech Class 36, and health apps Class 44 — but check Class 9 regardless of what else fits.
Can the App Store remove my app over a trademark?
Yes. Both Apple and Google operate intellectual-property complaint processes, and a valid complaint can get a live, earning listing taken down. Neither store screens your name for trademarks when you submit, so passing review is not evidence that the name is clear.
My app name is free on the App Store — does that mean it is clear?
No. Store availability and trademark rights are unrelated. Apple only checks whether another listing already uses the name; it does not check any register. A name can be free on both stores and still infringe a registered mark in Class 9.
